Terms of Service

Welcome to FilmCatch. These Terms of Service (“Terms”) are a binding agreement between you and Myers Entertainment LLC, a Florida limited liability company (“FilmCatch,” “we,” “us,” or “our”), and govern your use of the FilmCatch mobile application, the filmcatch.app website, and all related services (together, the “Service”). Please read them carefully — the short, human summary is: be at least 13, play fair, be decent to other collectors, stay safe in the real world, and know that in-game items aren’t real-world money.

1. Acceptance of these Terms

By creating an account, downloading the app, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Service. If you use the Service on behalf of someone else (for example, a minor in your care where permitted), you represent that you have authority to bind them to these Terms.

2. Eligibility and your account

You must be at least 13 years old — or older where your country’s law sets a higher minimum age of digital consent — to use FilmCatch. By using the Service you represent that you meet this requirement and that you are legally capable of entering into this agreement.

You need an account to play. You agree to:

  • provide accurate registration information and keep it current;
  • keep your sign-in credentials confidential and not share your account;
  • notify us promptly at support@filmcatch.app if you suspect unauthorized use of your account.

You are responsible for all activity that occurs under your account. We may refuse, reclaim, or require you to change display names that are offensive, misleading, or infringe someone else’s rights.

3. Your license to use the Service

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the FilmCatch app on Apple-branded devices that you own or control, for your personal, non-commercial entertainment. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works from any part of the Service except where the law expressly permits it despite this restriction.

4. Virtual currencies and items

The Service includes virtual currencies (such as Tickets and Gems) and virtual items (such as film cards, holographic and PREMIERE editions, loot boxes, box vouchers, charms, streak freezes, and pins) (together, “Virtual Items”). You acknowledge and agree that:

  • Virtual Items are licensed to you for use within the Service, not sold. You receive a limited, revocable license to use them in-game and own no property interest in them;
  • Virtual Items have no real-world monetary value, cannot be redeemed for cash or anything of value outside the Service, and cannot be transferred outside the Service;
  • where a loot box or similar mechanic is offered, the odds of receiving each rarity tier are disclosed in the app before you open it;
  • we may modify, rebalance, add, or remove Virtual Items, drop rates, pricing, and game features at any time to keep the game fair, lawful, and sustainable;
  • Virtual Items associated with your account are forfeited when your account is deleted or terminated.

5. Purchases, payments, and refunds

FilmCatch is free to play. Optional in-app purchases (for example, Gem packs or the Starter Bundle) are processed by Apple through the App Store — we never receive or store your payment card details. Prices are shown before you confirm a purchase and may change. All purchases are final to the extent permitted by law; refund requests are handled by Apple under the App Store’s refund policies, and we do not control Apple’s refund decisions. Virtual currency you purchase is added to your account balance and is subject to Section 4.

6. Rewarded ads

The Service may offer optional rewarded video advertisements — short third-party ads you can choose to watch in exchange for in-game rewards. Watching them is always your choice; they are served by third-party advertising partners (currently Google AdMob), and their collection of data in connection with ads is described in our Privacy Policy. Rewards are credited only for ads completed through the app’s normal flow; attempting to manipulate or automate ad rewards violates Section 8.

7. Trading, auctions, and gifting

FilmCatch includes player-to-player features: marketplace listings priced in in-game currency, timed auctions (including optional Buy Now), and gifting of films and in-game currency to friends. You agree that:

  • trades, auction bids, purchases, and gifts are actions you take voluntarily, and completed exchanges are generally final;
  • listings may expire after a set period (currently 7 days) and can be relisted;
  • bidding in an auction is a commitment to complete the exchange if you win;
  • all exchanges must use in-game currency and items only — buying or selling accounts, Virtual Items, or in-game services for real money or anything of value outside the game (“real-money trading”) is prohibited;
  • we may cancel listings, reverse exchanges, and remove items where we reasonably believe cheating, fraud, exploitation of a bug, or a violation of these Terms was involved.

8. Fair play

The game only works if the map is honest. You agree not to:

  • falsify, spoof, or manipulate your device’s location, or use the Service with a device whose location services have been tampered with;
  • use bots, scripts, automation, emulators, or unauthorized third-party software to play, farm, scan, or trade;
  • exploit bugs or unintended mechanics for advantage (found one? report it to support@filmcatch.app — we’re grateful);
  • engage in real-money trading, account sharing, or account sales;
  • interfere with, disrupt, probe, or overload the Service or its infrastructure, or attempt to access data or accounts that aren’t yours;
  • scrape, harvest, or bulk-export data from the Service.

9. Your content

The Service lets you submit content such as display names, profile bios, photos, notes, and trade messages (“User Content”). You retain ownership of your User Content. By submitting it, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute it within the Service for the purposes of operating, promoting, and improving the game. This license ends when your User Content is deleted from the Service, except where it has already been shared with other players (for example, a message in a completed trade) or where retention is required by law.

You represent that you have the rights to the User Content you submit and that it does not infringe anyone else’s rights, including intellectual-property, privacy, and publicity rights.

10. Community conduct and moderation

There is zero tolerance for objectionable content or abusive behavior on FilmCatch. Without limiting Section 8, you may not post or transmit User Content that:

  • harasses, bullies, threatens, or defames anyone;
  • is hateful, discriminatory, sexually explicit, or gratuitously violent;
  • is spam, a scam, or deceptive impersonation of any person or entity;
  • contains anyone’s personal information without their consent;
  • is unlawful or encourages unlawful activity.

You can report content and block players anywhere content appears in the app. We review reports and act on violations — typically within 24 hours — including removing content, restricting features, and suspending or terminating accounts. We may (but are not obligated to) monitor User Content, and we may remove any content at our discretion.

11. Location and real-world safety

FilmCatch is played in the real world, and the real world has cars, curbs, strangers, and private property. You agree to play safely and lawfully at all times, including:

  • never playing while driving, cycling, or operating anything that moves;
  • staying aware of your surroundings and not playing where your attention is needed;
  • respecting private property and restricted areas — a film spawn is never permission to enter anywhere;
  • following local laws, rules, and posted signs.

You use the Service at your own risk. Spawn locations are generated algorithmically and we do not guarantee that any location is safe, accessible, or lawful to visit. To the fullest extent permitted by law, we are not responsible for injuries, property damage, or losses arising from your real-world activity while playing.

12. Intellectual property and film data

The Service — including the FilmCatch name, logo, app design, artwork, gameplay systems, and software — is owned by Myers Entertainment LLC or its licensors and is protected by intellectual-property laws. Except for the license in Section 3, no rights are granted to you.

Film titles, poster images, credits, and related metadata are supplied by TMDB. This product uses the TMDB API but is not endorsed or certified by TMDB. All film content, titles, and artwork belong to their respective rights holders; a film’s appearance in FilmCatch does not imply any affiliation with or endorsement by its rights holders.

If you send us feedback or suggestions, you grant us the right to use them without restriction or compensation.

13. Copyright complaints (DMCA)

We respect intellectual-property rights and will respond to notices that comply with the Digital Millennium Copyright Act. If you believe content on the Service infringes your copyright, send a notice to support@filmcatch.app with: (a) identification of the copyrighted work; (b) identification and location of the allegedly infringing material; (c) your contact information; (d) a statement of good-faith belief that the use is unauthorized; (e) a statement, under penalty of perjury, that the notice is accurate and you are authorized to act for the copyright owner; and (f) your physical or electronic signature. We may remove content, notify the affected user, and terminate repeat infringers.

14. Third-party services

The Service depends on third-party services — including Apple (distribution and payments), Supabase (authentication, database, and storage), Expo (push notification delivery), Google AdMob (rewarded ads), and TMDB (film data). Their availability is outside our control, and your use of the app is also subject to Apple’s Licensed Application End User License Agreement and App Store terms. Apple is not a party to these Terms, has no obligation to provide support for the Service, and is a third-party beneficiary of these Terms with the right to enforce them against you.

15. Suspension and termination

You can stop using the Service at any time and can permanently delete your account in the app (Settings → Data → Delete account). We may suspend, restrict, or terminate your account — with or without notice — if we reasonably believe you have violated these Terms, created risk or legal exposure for us or other players, or where required by law. We may also discontinue the Service (in whole or part) with reasonable advance notice where practicable. Upon any termination or deletion, your license ends and your Virtual Items are forfeited without refund, except where a refund is required by applicable law. Sections 4 and 9–22 survive termination.

16. Service changes and disclaimers

We work hard to keep FilmCatch running, but the Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, error-free, or secure, that spawns will appear in any particular place, or that any content (including film data supplied by third parties) is accurate. Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.

17. Limitation of liability

To the fullest extent permitted by law: (a) Myers Entertainment LLC will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising from or related to the Service, even if advised of the possibility; and (b) our total aggregate liability for all claims relating to the Service will not exceed the greater of (i) the amounts you paid us through the Service in the 12 months before the claim arose, or (ii) fifty US dollars (US$50). Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot lawfully be limited, including for gross negligence, willful misconduct, or fraud.

18. Indemnification

You agree to defend, indemnify, and hold harmless Myers Entertainment LLC and its officers, members, employees, and agents from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your User Content, your violation of these Terms, or your violation of any law or third-party right in connection with your use of the Service.

19. Governing law and disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Before filing any claim, you agree to first contact us at support@filmcatch.app and give us 30 days to try to resolve the dispute informally — most issues get fixed this way. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Manatee County, Florida, and you and we each consent to their jurisdiction, except that either party may bring an individual claim in small claims court where eligible. To the extent permitted by law, any claim must be filed within one year after it arose.

20. Changes to these Terms

As the game evolves, we may update these Terms. If a change is material, we will give reasonable notice — for example, in the app or by email — before it takes effect. The “Effective date” above always reflects the current version. Continuing to use the Service after an update takes effect means you accept the updated Terms; if you do not agree, stop using the Service and delete your account.

21. Miscellaneous

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Nothing in these Terms creates a partnership, employment, or agency relationship.
